Terms and Conditions of Service

These Terms and Conditions (“Agreement”) govern the use of services provided by Printing Services Inc., a commercial printing company (“We”, “Us”, or “Our”), to you, the customer (“You” or “Your”). By using our services, placing an order, or entering into a contract with us, you agree to be bound by these Terms and Conditions.
1. Services Provided
We provide a range of commercial printing services, including but not limited to offset printing, digital printing, large format printing, binding, and finishing services (the “Services”). The scope of services is as specified in the quote or order confirmation issued to you.
2. Orders
(a) Order Placement: Orders can be placed via our website, email, phone, or in person at our office.
(b) Order Confirmation: An order is not considered confirmed until we receive a written/verbal confirmation from you.
(c) Accuracy of Information: You are responsible for providing accurate information (e.g., specifications, artwork, quantities, delivery address) for your order. We will not be responsible for errors due to inaccurate or incomplete information provided by you.
3. Pricing and Payment
(a) Pricing: All pricing is based on the scope of work and is subject to change based on specific customer requirements. An official quote will be provided upon request.
(b) Payment Terms: Full payment or a deposit may be required before production begins, depending on the project size. Payment Terms are Net 15 unless stated otherwise.
(c) Late Payments: Invoices that remain unpaid after the due date may incur late fees, interest, and/or service interruptions. We reserve the right to withhold services or refuse to deliver until full payment is received.
4. Artwork and Design
(a) Customer Responsibility: You are responsible for ensuring that the files, artwork, logos, and designs you provide are accurate, free from errors, and suitable for printing. We are not liable for any issues caused by the quality of the artwork provided.
(b) File Formats: Artwork should be submitted in the appropriate file formats, such as .PDF, .AI, .EPS, .TIFF, or .JPEG, as specified in the order.
(c) Proof Approval: We will provide a proof of the artwork or design for approval before printing begins, if requested by you. It is your responsibility to carefully review the proof for accuracy. We will proceed with printing only after receiving written/verbal approval from you. Any changes after approval may incur additional charges.
5. Production and Delivery
(a) Lead Time: The estimated completion time for your order is provided in the order confirmation. Delays may occur due to circumstances beyond our control, such as equipment failure or supplier delays.
(b) Delivery: Delivery charges will be specified in the quote or order confirmation. We are not responsible for delays in delivery caused by third-party carriers or unforeseen circumstances.
(c) Inspection: Upon delivery, you are responsible for inspecting the final product. Any issues or defects must be reported to us within 10 business days of receipt.
6. Cancellation and Changes
(a) Order Cancellation: Once an order is confirmed and production has started, cancellations may not be accepted. If cancellation is requested before production begins, a cancellation fee may apply.
(b) Changes to Order: Any changes to an order (e.g., specifications, quantity) after confirmation may result in delays and additional charges. You must request any changes in writing.
7. Liability
(a) Limitation of Liability: Our liability for any claim related to the printing of your order shall be limited to the cost of the order in question.
(b) Indemnification: You agree to indemnify and hold us harmless from any claims, losses, or damages arising from the use of your design, trademark, or copyrighted material in the printing process.
8. Copyright and Ownership
(a) Copyright: You represent and warrant that you have all necessary rights to the content (e.g., artwork, logos, images) provided to us. We do not claim ownership of any materials you provide.
(b) Retention of Artwork: We may retain copies of the artwork and printed materials for internal use, including marketing and promotional purposes, unless otherwise agreed upon in writing.
9. Confidentiality
We will treat all customer information, including proprietary designs and materials, with confidentiality. We will not share or disclose such information to third parties without your consent, except as required by law.
10. Force Majeure
We are not liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, labor disputes, shortages of materials, transportation delays, and equipment failure.
11. Governing Law and Dispute Resolution
(a) Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Iowa.
(b) Dispute Resolution: Any disputes arising from or related to this Agreement shall be resolved through binding arbitration in Iowa, in accordance with the rules of the American Arbitration Association.
12. Amendments
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website and will apply to all orders placed after the date of modification.
